Terms of Service

1. Acceptance
By creating an account or using Traced ("the platform", "the service"), you agree to these Terms of Service. If you do not agree, do not use the platform. Traced is operated out of Canada.
2. Eligibility
You must be at least 16 years old to use Traced. By creating an account you represent that you meet this requirement and that the information you provide is accurate and complete.
3. Accounts
- Each account is for a single person. Do not share your credentials.
- You are responsible for all activity under your account.
- Keep your password secure. If you suspect unauthorized access, change your password immediately and contact us.
- We may suspend or terminate accounts that violate these terms.
4. Acceptable use
You agree not to:
- Submit fraudulent, misleading, or fake job applications or postings
- Scrape, crawl, or automatically extract data from the platform
- Harass, abuse, or threaten other users
- Attempt to gain unauthorized access to other accounts or platform systems
- Use the platform for any unlawful purpose
- Interfere with or disrupt the operation of the service
- Circumvent any limits or restrictions imposed by your plan
5. Organizations and employers
Traced is a software platform that helps organizations manage hiring workflows. Traced is not an employer, recruiter, staffing agency, or party to any employment relationship between an organization and a candidate. If you create or manage an organization on Traced, you are solely responsible for your job postings, screening questions, assessments, interview process, and all hiring decisions.
You are responsible for complying with all applicable employment, labour, privacy, anti-discrimination, accessibility, pay-transparency, and human-rights laws in every jurisdiction where you recruit or hire. That includes how you write job descriptions, which questions you ask, how you evaluate candidates, and how you communicate outcomes. Traced does not review, approve, or endorse job postings or hiring practices and does not provide legal advice.
You are also responsible for handling candidate data lawfully, responding to candidate requests, and meeting any notice or record-keeping obligations that apply to your organization. If you close an organization on Traced, you remain responsible for any legal obligations to candidates that arose from your hiring activity before or during closure.
6. Content and intellectual property
Your content. You retain ownership of content you submit to Traced, including resumes, application answers, assessment responses, and code submissions. By submitting content, you grant Traced a limited license to store, display, and process it as necessary to provide the service (for example, delivering your application to an employer or running your code in a sandboxed environment for grading).
Assessment code. Code you submit during assessments is used solely for evaluation purposes. We do not claim ownership of your code and do not use it for any purpose other than grading your assessment.
Platform. Traced and its design, features, and branding are owned by Traced. You may not copy, modify, or distribute any part of the platform without permission.
7. Billing and subscriptions
Paid plans are billed on a recurring monthly basis through Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel. You can manage or cancel your subscription from the billing page or through the Stripe Customer Portal.
- Plan changes take effect at the start of the next billing period unless otherwise noted.
- If additional usage is enabled, overages beyond your plan limits are billed to your subscription at the rates shown on the pricing page.
- Refunds are handled on a case-by-case basis. Contact us if you believe you were charged in error.
- If you close an organization, your subscription may be canceled and a final invoice may be issued immediately for usage during the billing period. You must pay any outstanding balance before the organization is permanently deleted. While closure is pending, job postings may be archived, active applications may be rejected, and scheduled interviews may be canceled.
8. Candidates
When you apply to a role on Traced, you are applying to the organization that posted the job, not to Traced. Traced does not make hiring decisions on behalf of employers. If an organization closes its workspace or stops accepting applications, your in-progress application may be marked as rejected and scheduled interviews may be canceled. The employer remains responsible for communicating with you where required by law.
9. Service availability
Traced is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free service. We may perform maintenance, updates, or changes that temporarily affect availability.
10. Limitation of liability
To the maximum extent permitted by law, Traced and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or opportunities arising from your use of or inability to use the platform.
Our total liability for any claim related to the service is limited to the amount you paid to Traced in the twelve (12) months preceding the claim, or $100 CAD, whichever is greater.
11. Termination
- You may delete your account at any time from your account settings.
- We may suspend or terminate your access if you violate these terms, with or without notice depending on the severity of the violation.
- If you have an active subscription and we terminate your account without cause, we will provide a pro-rated refund for the remaining billing period.
12. Governing law
These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes will be resolved in the courts located in Ontario, Canada.
13. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform. Your continued use of Traced after changes take effect constitutes acceptance of the updated terms.
